📋 The Four Cases Under Article 81
An employee has the right to terminate their contract immediately without notice while keeping all their entitlements in these cases:
- Danger to health and safety: If the employer assigns you work that threatens your health or physical safety
- Breach of contractual obligations: If the employer fails to fulfill their obligations under the contract (such as repeated salary delays)
- Physical assault: If you are assaulted by the employer or their representatives
- Harassment or abuse: Any form of harassment or abuse in the workplace
⚖️ What Happens as a Result
In these cases, the termination is treated as if it was initiated by the employer, meaning you are entitled to the full end-of-service award, notice pay, and Article 77 compensation.
📜 Article 81 — Labor Law: An employee may leave work without notice while retaining their right to the award in specific cases.
💡 Document the reason before leaving — messages, photos, witnesses. Documentation is the key to proving your rights later.
