⚠️ The Most Common Trick
Some employers ask employees to sign a resignation letter when they are actually terminating them, in order to avoid paying compensation. This is legal circumvention.
⚖️ The Legal Position
An agreement entered into under duress or pressure can be challenged. A resignation made under:
- Threats of defamation or malicious accusations
- Documented psychological coercion
- Substantial changes to working conditions to force you to leave
...is treated legally as an employer-initiated termination.
📋 How Do You Prove Duress?
- WhatsApp or email messages demonstrating the pressure
- Testimony from colleagues who witnessed the situation
- Documentation of sudden shifts in working conditions prior to the resignation
📜 Saudi Civil Transactions Law: An agreement entered into under duress is voidable. Labor Law Article 77: Unfair dismissal entitles you to compensation regardless of the document's phrasing.
