⏰ The binding deadlines under Article 88

The Labor Law sets two different deadlines for paying dues:

  • 🔴 If the employer ends the relationship: within one week of the termination date
  • 🟡 If the worker ends the relationship: within two weeks of the termination date

🚨 What does a delay mean?

A delay exposes the employer to a complaint before the Ministry of Human Resources and financial penalties. The worker is also entitled to claim compensation for the delay in addition to the original dues.

📋 What must be paid upon termination

  • ✅ End-of-Service Gratuity
  • ✅ Notice period compensation (if not given)
  • ✅ Unused leave balance
  • ✅ Any overdue wages or amounts
📜 Article 88 — Labor Law: If the employer terminates the employment contract, they must pay the worker their wage and all their dues within a week of the contract's termination.

💡 If your employer is late beyond the legal deadline, file a complaint immediately on the Musaned platform or Wedi. The delay is added as a separate violation that strengthens your legal position.

⚠️ Do not wait until the statute of limitations (12 months) runs out. Every day of delay weakens your position and gives the employer a chance to evade responsibility.
