📋 Comparison

  • 🔵 Open-ended (Indefinite): Continues until terminated by either party — requires 60 days' notice
  • 🟡 Fixed-term: Has an end date — expires naturally without notice

🔑 The Automatic Conversion Rule

If both parties continue working under a fixed-term contract after it ends without a new agreement — it converts automatically to an open-ended contract under Article 74. This gives you all the rights of an open-ended contract.

⚠️ Watch Out for Repeated Renewals

Some companies repeatedly renew fixed-term contracts to avoid building up employee rights. If your fixed-term contract is renewed more than twice, or the contract period plus renewals reaches 4 years — the law considers it open-ended.

📜 Article 74 — Labor Law: If both parties continue to perform the fixed-term contract after its expiry, it is deemed renewed for an indefinite term.

⚠️ Do not let the employer interpret your contract type to their benefit. Always keep a copy of your contract and renewal dates.
