The Residency Right of a Foreign Widow with Saudi Children

4 min read

The short answer

Losing your husband doesn't necessarily mean losing your right to stay near your children — the law explicitly protects this right.

Losing a husband is difficult enough on its own, and it becomes even more anxiety-inducing for a foreign widow to wonder: will I be forced to leave Saudi Arabia and leave my Saudi children behind? The legal answer is clear: no, if specific conditions are met, you have a genuine right to stay.

📜 The Legal Basis for This Right

The Council of Ministers, under Decision No. 1215 of 1392H, approved granting foreign widows who have Saudi children from their deceased husbands the right of residency in the Kingdom, in recognition of the social and humanitarian need of Saudi children for their mothers to remain and care for them.

📜 The Decision's Humanitarian Basis

"Given the humanitarian and social consequences of this matter, represented in the need of Saudi children for the care of their non-Saudi mothers, the Ministry saw fit to approve granting foreign widows of Saudis who have Saudi children the right of residency in the Kingdom."

✅ The Five Required Conditions

  1. Proving she has children from her deceased husband.
  2. Having a Saudi mahram (male guardian).
  3. Having a sponsor who satisfies the requirements of the Residency Law.
  4. Not being among those undesirable on religious, political, or moral grounds.
  5. The sponsor must undertake to report her to the authorities if she is unable to work due to a legal impediment.
📌 What Does This Mean for You in Practice?

This right stands on its own and is separate from any pending inheritance or custody proceedings. Don't wait for those proceedings to conclude before arranging your official status — applying to prove you meet the five conditions is the first, independent step to securing your residency right.

✅ What should you do now?

  1. Gather documents proving your children from your deceased husband (birth certificates, proof of lineage).
  2. Identify a Saudi mahram who can support your application, and a sponsor who meets the Residency Law requirements.
  3. Visit the nearest expatriate control office or passports office to submit a residency application specifically under this decision.
  4. Use Sanad to understand your exact legal steps if you face any complications in the process.
